Work Session - Kimball City Hall
November 25, 2009 - 7:00pm
Kimball, Minnesota
Manager Brunsell called the CRWD Work Session to order at
7:00pm. Manager’s Brunsell, Kampa, Risberg, Froyen, and Schiefelbein were
present. Also in attendance were Eric Loewen, Attorney Stan Weinberger, Chuck
Sterling, Tammy Konz, Engineer Rebecca Kluckhohn, Assistant Administrator
Loewen, and Administrator Anderson.
Motion #WS09-11-1:
Motion Kampa, seconded by Schiefelbein to adopt the Agenda that will include a
corporate resolution consideration. All Managers voted aye.
Discussion was held regarding a recommendation to submit to
the Minnesota Association of Watershed Districts a questionnaire for watershed
district levy limits.
Engineer Kluckhohn reviewed and recommended acceptance of a
plan to rectify stormwater negative effects on Willow Creek. The plan calls for
spray irrigation of stormwater at a cost of $134,000, which would prevent 260
pounds of phosphorus per year from entering Willow Creek. Tammy Konz, Kimball
City Mayor, expressed willingness for the city to consider co-operating with the
CRWD in stormwater management.
Motion #WS-09-11-2:
Motion Risberg, seconded by Froyen to submit a grant proposal to the Clean Water
Partnership that addresses Kimball stormwater and Willow Creek habitat. All
Managers voted aye.
Eric Loewen, Chuck Sterling, and Tammy Konz left the meeting
at 7:55pm.
Motion #WS-09-11-3:
Motion Froyen, seconded by Risberg to recommend to the Minnesota Association of
Watershed Districts that watershed districts should be able to increase their
levy limit $100,000. Managers Risberg, Froyen, Brunsell, and Kampa voted aye.
Manager Schiefelbein voted nay. The motion carried.
Engineer Kluckhohn left the meeting at 8:19pm.
Board Chairman Brunsell explained that Workmen’s Comp
covers managers as well as volunteers who are under CRWD direct supervision.
Motion #WS-09-11-4:
Motion Kampa, seconded by Risberg to adopt the following resolution:
WHEREAS, the law enables elected or appointed officials of
the Clearwater River Watershed District to be covered; and
WHEREAS, the appointed board members intent is that they will be included as
employees;
NOW THEREFORE BE IT RESOLVED that the Minnesota Workers’ Compensation Law
cover the appointed board members of the Clearwater River Watershed District. All
Managers voted aye.
Assistant Administrator Loewen indicated that the Cedar Lake
Project 06-1 Account Code is 215-42215 and that the Wastewater Task Force will
meet December 2, 2009 at 7:00pm.
Motion #WS-09-11-5:
Motion Schiefelbein, seconded by Froyen to pay bills. All Managers voted aye.
Administrator Anderson indicated that Ron Graham,
representing the Clear Lake Property Owners, has asked the CRWD to re-enter
negotiations with Cory Meierhofer for the purpose of securing a perpetual
easement on his property.
Motion #WS-09-11-6:
Motion Froyen, seconded by Risberg to authorize Administrator Anderson to submit
a letter to Cory Meierhofer asking that the CRWD negotiate a proposed perpetual
easement on his property. All Managers voted aye.
Motion #WS-09-11-7:
Motion Schiefelbein, seconded by Risberg to adjourn the meeting. All Managers
voted aye.
