CRWD SPECIAL MEETING

ANNANDALE MIDDLE SCHOOL - ANNANDALE, MN

JULY 21, 2004 

KIMBALL, MINNESOTA 55302

A special meeting was called to order at 7:00p.m. by Manager Froyen. Managers Roland Froyen, Virl Liebrenz, Marvin Brunsell, and Robert Schiefelbein  were present. Manager Mark Kampa was absent. Merle Anderson, District Administrator and Tom Melloy, Attorney were in attendance. Twenty-three residents of the CRWD were also present and identified on the attached attendance sheet.

Administrator Anderson welcomed the residents to the meeting and reviewed the following items to be discussed:

1. Bid tally sheet for Clearwater Harbor Area Sanitary Sewer Project.

2. Review of the appeal status.

3. Proposed final assessment for Clearwater Harbor Area Sanitary Sewer Project.

Tom Melloy, CRWD Attorney for the appeal, indicated that the judge has denied a request for a new trial and also denied a request to put off the project until a later date. The appellants have appealed to the Court of Appeals. The CRWD has not received any correspondence from the Court of Appeals. Mr. Melloy advised the Board of Managers that they are at liberty to award the bid and proceed with the project or voluntary not award the contract.

Administrator Anderson reviewed the bid tally sheet with all present. Residents of the CRWD in attendance,  encouraged the Board of Managers to proceed with the project.

Motion #SM04-07-1a:  Brunsell, seconded by Liebrenz made a motion to award the contract to the lowest responsible bidder, Kober Construction, authorize CRWD President and Secretary to sign contracts, and that Manager’s approve the contract as presented. All Managers voted aye.

Administrator Anderson reviewed the proposed assessment roll with all present. The Board of Managers will consider this assessment roll when the Public Assessment Hearing is reconvened on July 28, 2004. The following questions were asked by those in attendance, with the answers to be available at the July 28, 2004 meeting:

1. Can the appeal costs be deducted from the project costs and paid for equally by each of the 82 units of benefit?

2. Is there another method of payment possible for those who may find it difficult to pay the annual assessment?

3. What length of time will the bond repayment schedule require, 20 or 30 years?

Manager Froyen adjourned the meeting.
