MINUTES CRWD SPECIAL MEETING STANLEY’S RESTAURANT JULY 8, 20 KIMBALL,
MINNESOTA 55302 A
special meeting was called to order at 6:00p.m. by Manager Froyen. Managers
Roland Froyen, Virl Liebrenz, Marvin Brunsell, Mark Kampa, and Robert
Schiefelbein
were present. Merle Anderson, District Administrator and Tom Melloy,
Attorney was also in attendance. Administrator
Anderson announced that this meeting was noticed to be held July 5, 2004. It was
later learned that July 5, 2004 was a legal holiday, so the meeting was
postponed until July 8, 2004. A postponement notice was posted at Stanley’s
Restaurant in Kimball, MN on July 4, 2004 and the legal notice was changed via
an e-mail to the newspapers on June 28,2004. Manager
Froyen called the meeting to order at 6:00pm. Motion
#SM04-07-1:
Froyen, seconded by Brunsell, made a motion to close the meeting to the
public at 6:07pm for Managers to discuss the status of litigation regarding the
Clearwater Harbor Area Sanitary Sewer Project with their attorney, Tom Melloy. All
Managers voted aye. The
Managers discussed the pending litigation regarding the Clearwater Harbor Area
Sanitary Sewer Project with Tom Melloy. Manager
Froyen re-opened the meeting at 7:12pm. Motion
#SM04-07-2:
Brunsell, seconded by Kampa made a motion to schedule and publish a
notice of Public Meeting for July 21, 2004, 7:00pm, at the Annandale Middle
School, Annandale, Minnesota. Letters will be sent to all affected parties in
the Clearwater Harbor area of the sanitary sewer
project. Purpose of the meeting is to review with all present the status
of the litigation, review and award bids for the Clearwater Harbor Area Sanitary
Sewer Project. All Managers voted aye. Motion
#SM04-07-3:
Schiefelbein, seconded by Liebrenz made a motion to reconvene the public hearing
for establishing the final assessment roll for the Clearwater Harbor Area
Sanitary Sewer Project on July 28, 2004, 7:00pm, Annandale Middle School,
Annandale, Minnesota. All Managers voted aye. Motion
#SM04-07-4:
Liebrenz, seconded by Schiefelbein made a motion to authorize Attorney Tom
Melloy to present Rule 68 Offer of Judgment, including Summary of Appellant‘s
Appraisal, and $1,000 judgment per appellant‘s property to all appellant‘s.
The entire copy of Rule 68 Offer of Judgment will be maintained in the District
Office. All
Managers voted aye. Administrator
Anderson reviewed the July 14, 2004 regular meeting agenda. Manager
Froyen adjourned the meeting.
